In Czech, any law graduate is a lawyer, a ‘právník’. That title alone does not entitle anyone to provide legal services as a profession. Legal services may be provided regularly and for a fee by an attorney-at-law, an ‘advokát’, and, within their statutory powers, by a notary, a tax adviser or a patent attorney.

An attorney-at-law is a lawyer entered on the roll of the Czech Bar Association. That means a statutory duty of confidentiality, compulsory indemnity insurance, disciplinary accountability to the Bar, and escrow recorded with the Bar, which only an attorney-at-law may hold.

Attorney escrow: how it protects the buyer and the seller

The buyer does not want to pay before being registered in the land register; the seller does not want to sign before the money is ready. Attorney escrow bridges that gap:

  • the buyer deposits the purchase price into a dedicated escrow account,
  • I release it to the seller once the conditions of the escrow agreement are met, usually after the new owner has been registered in the land register,
  • I record every escrow in the electronic escrow register of the Czech Bar Association.

No. In the Czech Republic, any law graduate is a lawyer. An attorney-at-law is a lawyer entered on the roll of the Czech Bar Association who may provide legal services regularly and for a fee and represent clients in court; a duty of confidentiality and compulsory indemnity insurance apply.
